Use of Personal Data

Access to some sections of the site and/or requests for information or services by the site's users may be conditional on the provision of personal data which CAMPIONE DEL GARDA S.p.A., in its capacity as Data Controller, will use in accordance with Italian Decree Law 196/2003 (hereinafter the Data Protection Law).
This information is provided to enable users to find out, even before accessing the various sections of the site and providing their data, how CAMPIONE DEL GARDA S.p.A uses personal data. Users are also required to view it before providing their personal data by compiling the relevant spaces in the various sections of the site.

Purposes for which the data are used

Depending on the needs expressed by users accessing the various sections of the site, personal data provided directly by users by compiling the on-line forms may be used for the following purposes:

a) for registration on the site, which may be necessary to access specific sections of the site and for the provision and management of the various services offered;
b) further to the user’s consent and until its withdrawal, for marketing operations (such as the dispatch of promotional and advertising material and the performance of the relative analyses on registered users which enable CAMPIONE DEL GARDA S.p.A to improve the services offered to its clientele), even by email, fax and mms and sms messages, further to the user’s consent and until its withdrawal;
c) dispatch of newsletters delivering updates on the latest innovations on the site;
d) response to users’ requests with regard to services, advertising or the site (“Contact us” section of the site).
User registration on the site is not required for the provision of some of the services offered by CAMPIONE DEL GARDA S.p.A (e.g. those referred to in points c) and d) above). However, for the management of any users' requests with regard to these services, they will be requested to provide personal data which will be used for the relative purposes only and for the time strictly necessary.

Procedures for use of the data

Personal data will be used in mainly automated form, by procedures strictly correlated to the aforesaid purposes.

Nature of the provision of personal data by users

The provision of personal data is optional but partly necessary (i.e. for the data where an asterisk appears next to the boxes) to enable CAMPIONE DEL GARDA S.p.A to fulfil the user’s requirements in relation to the functions of the site. Failure to provide all the essential personal data marked with an asterisk, completely and accurately, will render the provision of the requested service impossible, while there will be no consequences in the event of failure to supply the optional personal data, or the entering of partial or inaccurate data.

Categories of personal data

In addition to the personal data provided directly by users (e.g. name, surname, postal and email addresses, etc.) when they log onto the site, the IT systems and software procedures which run the site indirectly acquire a number of personal data the transmission of which is implicit in the use of Internet communications protocols.
These data are only used for anonymous statistical surveys.

Categories of subjects to which users' personal data may be disclosed

Personal data may be disclosed to employees or associates of the Data Controller's Marketing Department who, working under the latter's direct authority, are appointed as data trustees or authorised users under articles 29 and 30 of the Data Protection Law, and who will receive appropriate operating instructions, as will the Trustees' employees or associates (under the responsibility of the Trustee).

Context of communication or distribution of users’ personal data.

Personal data supplied directly by users by compiling the on-line forms will not be disclosed to third parties or distributed except in the event of the posting on the site of the names of the winners of any competitions or prize schemes promoted by CAMPIONE DEL GARDA S.p.A by means of the site.

Users’ rights under art. 7 of the Data Protection Law

Article 7 - Right of Access to Personal Data and Other Rights
1. The data subject is entitled to obtain confirmation as to whether or not data relating to him are held, even if they have not yet been recorded, and the communication of the same in an intelligible form.
2. The data subject is entitled to obtain the following information:
a) the origin of the personal data;
b) the purposes of their use and the methods used;
c) the logic applied if the data are used by electronic means;
d) the identity of the controller, the trustees and the designated representative in Italy, if any;
e) the recipients or categories of recipients to whom the personal data may be disclosed or who may acquire the same as designated representative in Italy, trustees or authorised users.
3. The data subject is entitled to obtain:
a) the updating, rectification or, if this is in his interest, the supplementation of the data;
b) the deletion, conversion into anonymous form or freezing of all data used in breach of the law, including those the conservation of which is not necessary for the purposes for which the data were collected or subsequently used;
c) the certification that the operations referred to in points a) and b) have been reported, also with regard to their contents, to those to whom the data have been communicated or distributed, unless this proves impossible or involves a disproportionate effort.
4. The data subject is entitled to oppose, in whole or in part:
a) on legitimate grounds, to the processing of data relating to him, even if such use is relevant to the purpose for which they were collected;
b) the use of personal data relating to him for the dispatch of advertising material or direct marketing, or for market research or commercial communications.
When exercising the above rights, the data subject may act directly or through another person or association authorised in writing.

Procedures for exercising the data subject’s rights under article 7 and obtaining the list of Data Trustees

The user may exercise their rights under art. 7 of the Data Protection Law, and obtain the full list of the Trustees, at any moment, by sending an email to the Data Controller's address info@campionedelgarda.it, or sending a letter by post to its address at Via S.Biagio, 75 – 42024 – Castelnovo di Sotto (RE)
Users who have consented to the use of their data for the purposes listed in point b) may withdraw this consent using their email address at any time by clicking on a link provided in every email message.
